ERC were held workshops on “the role of Trade Union Organizations in carrying on collective negotiations and concluding of agreements”

The first workshop for the chairs and representatives of the cultural workers’ trade union was held on October 19, 2011 in Baku city in the Hotel “Ambassador”. The chairs and representatives of the trade unions carrying out their activity in the cultural institutions located in Baku city. In the workshop, the ERC experts Mr. Fuat Rasulov and Mr. Galib Togrul have made presentations correspondingly on the subjects of “Social dialogue in employment relations, its role, goals and advantages” and “Rules for conducting of collective negotiations, preparation and concluding of collective agreements”.

 

At the same time, Mr. Mirza Alibayov, the head of department of RCCWTU, appearing on the theme of “Content of the collective agreements and parties’ mutual obligations” provided the workshop participants with practical recommendations. While the appearances made by the both three experts, there was built an interactive dialogue with the workshop participants and their questions were duly answered.
There were held regional workshops in Shaki and Ganja for the chairmen and representatives of the first trade union organizations of cultural workers. The next workshop was taken place on October 24. The arrangement was taken place in the Conference Hall of the Tourism-Information Centre in Shaki. According to the event’s agenda, it was guided by Mr. Fuat Rasulov, the professor, chairman of the Board. The workshop has been joined by chairmen and representatives of the first trade union organizations in the cultural institutions located in Balakan, Gakh, Ismayilli, Zagatala, Gabala and Shaki.

The first representation in the workshop has been made by Mr. Galib Togrul, the ERC expert on the subject of “Social dialogue in the Republic of Azerbaijan: its role, goals and advantages”. The aforementioned expert, appearing on this theme provided the participants with the information concerning the history of social dialogue, its current state in Azerbaijan, rules for conducting of the collective negotiations, its legislative basis, parties to the collective agreement and collective treaty, its content, parties’ obligations and penalties imposed for violation of the requirements and norms prescribed by these agreements and treaties. In the course of presentation, the participants of the event joined the discussions. Mr. G.Togrul answered their questions and drawn their attention to the fact of passing longer of the negotiations related to the obligations contained in some sections of an agreement while concluding of the collective agreements to revive an interest to the discussions.

In the second session of this event, Mr. Mirza Alibayov, the head of department of RCCWTU has addressed the meeting on the theme of “Collective agreement, its content, and parties’ mutual obligations, conducting of negotiations and signing of the agreement”. After the lecture, the workshop participants were divided into groups and they were given tasks relating to the preparation of the collective agreement. The group called conditionally “Employer” was guided by F.RAsulov and the group of “first trade unions” by M.Alibayov.
After the dinner break, the experts carried out corresponding works with the groups in terms of fulfilling tasks. Then, the both groups made representations. The presentations were made in an interactive manner and there were made discussions on the theme. After the presentation, the workshop participants shared their ideas regarding the workshop and prepared their final estimation.
The second regional workshop for cultural workers’ trade union organizations was organized in Ganja city on October 25. It was held in the Conference Hall of the Public Library in the city (photos are appended). The chairmen and representatives of the tarde union organizations of the districts and cities such as: Tovuz, Gazakh, Naftalan, Gornaboy, Samukh, Ganja, Goygol and Dashkasan participated in the event. According to the workshop’s agenda (it is appended) the first presentation has been made by Mr. Galib Togrul, the ERC expert. After the presentation made by this expert on the theme of “Social dialogue in the Republic of Azerbaijan: its role, goals and advantages”, Mr. Mirza Alibayor, the head of department of RCCWTU organized a practical course relating to the subject of “Collective agreement, its content, parties mutual obligations, conducting of negotiations and signing of the agreement”.
While appearance of the both lecturers, there have been organized discussions and the questions of participants were answered. After the dinner break, the event participants were distributed lists and they were asked to note on the difficulties met by them while conducting of collective negotiations on one list and the successes on the other list. Then, the existing problems and advantages being grouped were noted in 2 flip-chats and there were conducted discussions around each point.
On November 16, there was held a workshop with the participation of Umud Huseynov, the chairman of the Independent Trade Unions of the Constructions Complex Workers (ITUCCW) and Mahir Ibrahimov, the chief engineering employment inspector in the hotel “Ambassador”, in Baku city; this event was joined by chairmen and representatives of the first trade union organizations of the construction units carrying out their activity in Baku city (photos are appended). The trade union organizations of the companies such as: “Baku Demir Beton-8”, “Garadagh Sement OJSC”, “Azertunelmetrotikinti”, the Pricing Centre of the Ministry of Emergencies, “Azertuneltikinti OJSC”, “Korgoz T.M.”, “Menzil-Tikinti”, “Inshaat 1S” and other organizations were represented in this arrangement. According to the event’s agenda, the ERC expert Mr. Fuat Rasulov was a moderator of all discussions.
Mr. Umud Huseynov, the chairman of ITUCCW touched upon various problems such as: the difficulties met by the first trade union organizations within the construction organizations and their typical features, at the same time he spoke about the obtained successes. Mr. U .Huseynov, stating about concluding of the collective treaty tripartite, but not bilateral because of absence of the field institution of the corresponding state authorities and employers guiding with this field said that they have chosen the big construction organizations and concerns as parties to the treaty. After the speech of the chairman, Mr. Galib Togrul, the ERC expert has been appeared with the presentation on the theme of “the Collective agreement and the collective treaty: International practice and Azerbaijan”. In the course of presentation, the participants were set interactive dialogue and their questions were answered. Then, the ERC experts Mr. Galib Togrul and Mr. Fuat Rasulov were appeared jointly with a presentation entitled “Social dialogue in the construction organizations: current situation and difficulties”. The workshop participants were set corresponding tasks after the presentation.
Then, Mr. Mahir Ibrahimov, the chief engineering inspector of ITUCCW has given a lecture on the theme of “work safety rules in the construction organizations and matters relating to observance the effective norms” and answered the questions of the workshop participants in this connection. He appeared with all-inclusive recommendations relating to the rules of reflecting of the matters concerning the work safety, employment condition and social safety in a collective agreement.

The last component of the event was summing up of the results of tasks set for the workshop participants and conducting of discussions around this subject.
