Economic Research Centre implements the project of “Assistance to trade unions in increasing of their role in organization of the social dialogue”
The Economic Research Centre implements the project of “Assistance to trade unions in increasing of their role in organization of the social dialogue” by the financial support of Friedrich Ebert Foundation / Germany. The Project anticipates organizing seminars relating to carrying on collective negotiations for the members of Trade Unions in Baku, Shaki and Ganja and conclusion of contracts and treaties.
The seminars include the subjects, such as: approach to the collective agreement determining legal norms amongst the participants of employment relations’ regulating process as a specific form of the cooperation act and the employment agreement, the functions fulfilled by these collective agreements in the economic subjects and their structure units, obligations undertaken while awarding the contracts by the parties, especially the trade unions and rules and principles of carrying on negotiations between the parties. Within the scope of the project there has been published the book “Collective negotiations and treaties. The guide for the members of the labour collectives and trade unions”.The first workshop was held on October 19 within the framework of the mentioned project. The workshop has been joined by the representatives of the first trade unions entering into the composition of the Cultural Workers’ Independent Trade Union. Mr. Galib Togrul, the executive director of ERC has called the meeting to order. He informed the participants about the main goal of the project, works done and to be executed and results to be obtained. Then, Mr. Fuad Rasulov, the ERC Board member and the project expert made representation on the subject of “Social dialogue in the employment relations in Azerbaijan, its role, goals and preferences”. In the course of this presentation, there has been provided all-inclusive information relating to the role of the social dialogue, the current situation in this field in Azerbaijan, the main national legislative acts regulating the activity of trade unions and cooperation of Azerbaijan with the International Labour Organization (ILO). He let known that Azerbaijan was ILO member from 1992 and joined 54 conventions up to present relating to the defence of employment rights and regulating contractual relationship by and between the employees, employers and trade unions. The national employment legislation enables the employees to establish trade unions in any enterprise on voluntary basis and without obtaining a consent from the employers and being members to any trade unions aiming at protecting their labour, social and economic rights and legal interests and to participate in their activity.
Then, Mr. Mirza Jafarzade, the head of department of the Cultural Workers’ Independent Trade Union provided the participants with information on the Master Collective Agreement and the procedure conclusion of the contract.
Mr. Galib Togrul made a presentation as regards the “collective agreement, signing process and parties’ mutual obligations”. He touched upon subjects implying the carrying on negotiations while concluding of collective agreements, requirement formulating, parties’ obligations, supervision on implementation of obligations and legislative requirements. At the end, the project experts answered the questions of the participants.
